2. Strict Prohibitions and Offences

- Commercial sales or dealing: Selling, buying, or commercially trading cannabis flower or live cuts without the required commercial licensing remains unlawful under South African law.
- Public consumption: Smoking, vaporising, or consuming cannabis in a public place remains prohibited.
- Public view and nuisance rules: Cultivation must take place out of public sight. Smoking in a private residence in a way that causes a public or neighbour nuisance is prohibited.
- Child safety: Adults must store plants and harvested material securely and keep them inaccessible to minors. Consuming cannabis in the presence of a child is a statutory offence.
3. Transporting Cannabis
When transporting live cuts or dried flower on public roads:
- Keep all material out of plain view, such as in a vehicle boot, glove compartment, closed bag, or sealed container.
- Drivers transporting cannabis should inform passengers. Any passenger carrying cannabis should keep it inside closed luggage or a vehicle storage compartment.
